These terms govern your use of North Pole Console (“the app”), provided by Kevin Nealon (“we”, “us”). By downloading or using the app, you agree to these terms.

The app

North Pole Console is a performance-preparation and presentation tool for professional Father Christmas performers, provided for lawful, professional use in preparing for and delivering in-person visits.

Subscription

North Pole Console is offered as an auto-renewing annual subscription with a free trial period, as shown at the point of purchase.

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
  • The subscription renews automatically for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription at any time in your device’s account settings (App Store or Google Play); the app itself has no separate cancellation mechanism.
  • Any unused portion of a free trial is forfeited if you purchase a subscription during the trial.
  • Prices may vary by region and are shown in the app and at checkout.

Licence

Subject to these terms, we grant you a personal, non-transferable, non-exclusive licence to use the app for its intended purpose on devices you own or control. Use of Apple-distributed copies is additionally governed by Apple’s standard Licensed Application End User Licence Agreement.

Acceptable use

You agree to use the app only for lawful purposes, and not to reverse engineer, resell, sublicense or otherwise misuse the app or its content.

Your content

Any information you enter (visit details, notes, messages, portrait, and so on) remains yours. It is stored locally on your device, as described in our Privacy Policy, and we claim no ownership over it.

Disclaimer

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including as to accuracy, reliability, or fitness for a particular purpose. Location-based features, such as the Santa Tracker, are presented for entertainment and performance purposes and are not a real-time tracking or safety service.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the app.

Changes

We may update these terms from time to time; continued use of the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
